Here you will find the Terms and Conditions for each product or service offered by Rebecca Jane Singh Design. Terms and conditions exist to protect both the business and the customer, If you are unsure or have any questions about something stated in our T&C’s please don’t hesitate to contact us.

Please read the following terms and conditions carefully, as by accepting any quotation provided, purchasing any packages or products on our website or engaging our services by any other means such as for custom orders and therefore effectively hiring Rebecca Jane Singh Design, it is deemed that the client has read and agreed to Rebecca Jane Singh Design’s terms and conditions as outlined below.

DEFINITIONS

The definitions below define common or frequently used terms within the terms and conditions, quotations or listings provided by or within the website of Rebecca Jane Singh Design.

  1. ‘Rebecca Jane Singh Design’ means Rebecca Jane Singh Trading as Rebecca Jane Singh Design.
  2. ‘RJS Design’ means Rebecca Jane Singh Design and is sometimes used in abbreviation of Rebecca Jane Singh Design where the full business or trading name is unable to be used or entered.
  3. ‘Client/Customer’ means a person/s, business or company who engages Rebecca Jane Singh Design for graphic design, custom apparel or accessories, promotional products & services, signage, labels and/or related services.
  4. ‘Quote/Quotation’ means the design or project quotation provided to the client in writing by Rebecca Jane Singh Design.
  5. ‘Project’ means the scope and purpose of the clients identified usage of the work to be produced or work produced as described in the quotation.
  6. ‘Service/Services’ means the service/s that are to be provided to the client by Rebecca Jane Singh Design, as described and otherwise further defined in the quotation.
  7. ‘Deliverable/s’ means the end product/s or files to be delivered by Rebecca Jane Singh Design to the client/customer, in the form, media or medium specified in the quotation.
  8. ‘File Types’ means the file format of any deliverable files, artwork, images or projects to the client.
  9. ‘Working Files’ means files that are editable, for example a file that may be opened in programs such as adobe illustrator or other similar programs with editable artwork or text etc.
  10. ‘Turnaround Time’ means the expected time it takes for a project as defined in the quotation or product listing to be completed by Rebecca Jane Singh Design.
  11. ‘Deadline’ means the date of which a client requires their project on or before.
  12. ‘Revisions’ means tweaks or changes to a concept or proof 
  13. ‘Unlimited Revisions within Reason’ means unlimited within reason, meaning to be unlimited within an amount that is considered fair and workable.

Design Services

Prior to commencement of work, a detailed design brief will be completed by the client.

GRAPHIC DESIGN PACKAGES

 Graphic Design Packages purchased on the website are paid in full upfront, once payment is made the client will be provided with a copy of our design brief to fill out, once the client has filled out the detailed design brief provided, an expected turn around time will be given. Expected turnaround time – expected turnaround time includes expected time taken to fulfil the design brief, expected turnaround time does not include revisions or time taken for client to provide feedback or approve final design.

Whilst all care is taken by Rebecca Jane Singh Design in producing proofs and final artwork, it is understood that the client assumes and accepts liability for any and all errors not corrected. The client is responsible for proof reading and identifying any errors or omissions, prior to final approval. Final artwork is not released to the client or third parties (eg. printers) until final approval of artwork is provided to Rebecca Jane Singh Design in writing – verbal approvals cannot be accepted.

Once finished design is submitted for review to the client and approved, the design is considered final.

Once designs are considered final any additional revisions or changes requested will incur an additional fee.

Additional fees will vary depending on the revision or change requested and as such will be quoted on a case by case basis. Fees for additional revisions or changes will be required to be paid in full prior to commencement of work.

Prior to handover the final invoice must be paid in full.

Once invoice is paid in full, all deliverables will be handed over either via DropBox or USB unless otherwise agreed prior to finalisation.

CUSTOM GRAPHIC DESIGN QUOTES

If you chose the custom quote option, you will need to briefly describe what you require (such as logo, business cards, flyers etc) and I will provide you with a detailed quote which will include, the full costings including a deposit amount that will require payment upfront before we can commence the design process, then if you choose to proceed with the custom quote I will forward you a design brief PDF and the deposit will then be required before commencement of work, the deposit amount will be specified in the detailed quote and an invoice will be provided once the quote is approved by the client.

The quote will include full cost of design work, deposit which is due prior to commencement of work, list of inclusions (such as file types, number of revisions included etc) expected turnaround time – expected turnaround time includes expected time taken to fulfil the design brief, expected turnaround time does not include revisions or time taken for client to approve final design.

PERSONAL DESIGN QUOTES

Personal Design Quotes require a deposit prior to commencement of work, the client will need to provide a brief overview of the project (invitations, digital illustration, custom labels, wall art etc) once I receive your project brief a detailed quote will be provided then should you decide to proceed, a deposit will then be required before commencement of work, the deposit amount will be specified in the detailed quote and an invoice will be provided once the quote is approved by the client.

The quote will include full cost of design work, deposit which is due prior to commencement of work, list of inclusions (such as file types, printing quotes, number of revisions included etc) expected turnaround time – expected turnaround time includes expected time taken to fulfil the design brief, expected turnaround time does not include revisions or time taken for client to approve final design.

FONTS

All fonts used in client branding or projects by Rebecca Jane Singh Design are commercially licensed to us only, we are unable to transfer any font files or licenses which we own for fonts used in clients branding to the client. If the client wishes to use a font included in their branding kit or project for any other purpose other than the final artwork or in finalised projects completed by us they will be required to purchase their own license for each of the fonts from the fonts creator and download a copy of the font and install it for use, clients should retain a copy of the license purchased for each of the fonts purchased for future reference.

We are happy to provide details to our clients of where they can purchase their own license for each of the fonts as well as reputable sources for the download of each font.

Apparel

Whilst our apparel suppliers try to maintain consistent sizing and colours between batches, occasionally there may be a slight variation between batches, while this is normal and variations should only be slight, it is something that we want you to be aware of.

Vinyl Labels & Products

APPLICATION

With each of our labels we provide application instructions to help guide you when applying your labels to your chosen surface.

It is recommended that you follow the application instructions carefully as correct application will ensure that your labels adhere properly to the surface as well as increase longevity.

If you are unsure about anything regarding the application process don’t hesitate to contact us, we will be happy to help clarify anything which you may not be sure about, no question is a silly question!

If you are local and want to take the hassle out of applying your labels to your chosen surface, take advantage of our application service. We can apply your labels directly to your items at no additional cost. Just specify at check out that you would like to drop your items off for the labels you have ordered to be applied.

We do not take any responsibility for misapplication or damage caused as a result of the customer not following the application instructions correctly.

CARE INSTRUCTIONS

Along with our application instructions are care instructions.

It is recommended that you follow these care instructions carefully to ensure that your labels last as long as possible.

If you are unsure of any of the care instructions provided we would be happy to clarify anything which you may be unsure about, don’t hesitate to contact us, we are only too happy to help!

We do not take any responsibility for damage caused as a result of the customer not following the care instructions correctly.

FONT & COLOUR SELECTION

It is recommended that you double check your font and colour selections before submitting your order.

Once your order has been processed and cutting has commenced, an additional fee may apply for changes to font or colour due to incorrect selection by the customer at the time of ordering. Fees for changes will vary depending on the project.

However, prior to commencement of cutting after your order is processed there will be no charge for changes to font and colour selection.

Due to variations in computer settings, colours may vary slightly between monitors and devices, and as such can differ slightly from the final product. By placing your order and making payment you are acknowledging and accepting this. We are not responsible for such variations in colour. We try our best to represent the true colour of each item or selection so that customers can make informed purchases.

SPELLING

It is recommended that you double check the spelling of any names/text before submitting your order.

We take no responsibility for spelling errors submitted by the customer, it is the customers responsibility to ensure that spelling is correct at time of submitting your order.

Once your order has been processed and cutting has commenced a fee will apply to fix any errors in spelling submitted by the customer at the time of ordering.

Should a spelling error be detected prior to commencement of cutting, there will be no charge to amend the error.

Generally, if we feel your spelling of a name or word is particularly unusual we may contact you before finalising your names/text for cutting, please don’t be offended if we do contact you about the unique spelling of a name or word, we are only doing this to ensure that we get it right the first time, this helps us reduce waste and ensure you receive the correct item.

Quotes

All quotes are provided by Rebecca Jane Singh Design free of charge and are valid for 30 days from the date of issue. Quotations that are not accepted within the time identified may be subject to change. All quotes are in Australian Dollars. Additional work which is outside the original scope and not provided for in the original quotation will be charged as an add on. Add on prices vary and as such a new quote for the add ons will be provided to the client.

Incomplete Projects

Any resources required to be supplied by the client in order to complete the project must be supplied within the specified time frame, failure to do so may result in your project being delayed or not being completed within the expected turnaround time or in some cases may result in the project being marked as incomplete, clients at risk of having their project marked as incomplete will have a reminder notice sent to the them notifying them that the deadline to supply the requested information to complete their project has passed and a date 7 calendar days from the date of issue of the reminder notice set for the requested information to be supplied, if the required information is not supplied within 7 calendar days of the date of issue of the reminder notice, at the discretion of Rebecca Jane Singh Design the project may be marked as incomplete and payment for the work completed thus far will be requested or deducted from any applicable refunds.

The client, within 7 calendar days of receipt of each proof, shall notify Rebecca Jane Singh Design of any amendments, corrections or changes the client wishes to be made in writing, verbal requests for amendments, changes or corrections cannot be accepted. Should the Client fail to contact Rebecca Jane Singh Design within 7 calendar days of receipt of proof/s, and notify Rebecca Jane Singh Design of any amendments, corrections, changes or approval of final work Rebecca Jane Singh Design reserves the right to consider the project finalised, and request payment of work completed. The client is responsible for all debt collection fees, legal fees and court fees that may be incurred as a result of the client’s failure to pay invoices within 7 calendar days of date of issue.   

Cancelled Projects

In the event of a project termination by either party Rebecca Jane Singh Design will issue an invoice for all work completed up to the date of cancellation, and payment of this invoice is required by the Client within 7 calendar days. The client is responsible for all debt collection fees, legal fees and court fees that may be incurred as a result of the client’s failure to pay invoices within 7 calendar days of date of issue.

Invoices & Payments

An invoice will be issued to the client for all work to be completed by Rebecca Jane Singh Design prior to commencement of work. The deposit stated in each quote and listed in the invoice will be payable upfront prior to commencement of work, deposit is due within 7 calendar days of date of issue of invoice, unless otherwise agreed until deposit is received work will not commence.

Final Payment is required in full within 7 calendar days of approval of final work and prior to release of deliverable files or products, and/or supplying files for offset or digital printing and websites. The client is responsible for all debt collection fees, legal fees and court fees that may be incurred as a result of the client’s failure to pay invoices within 7 calendar days of date of issue.

Deadlines

Every effort possible is made by Rebecca Jane Singh Design to meet required deadlines. Additional charges may apply if Rebecca Jane Singh Design is required to work outside of normal business hours in order to meet deadlines. It is the client’s responsibility to notify Rebecca Jane Singh Design of deadlines prior to the commencement of the project. Rebecca Jane Singh Design will not be liable or held responsible for any deadlines not met, or any costs incurred as a result, due to circumstances beyond Rebecca Jane Singh Design control, such as illness, injury, client delay, or third-party or sub-contractor turnaround times. Final approval of artwork must also be provided to Rebecca Jane Singh Design in writing before any work is released – verbal approvals cannot be accepted.

Use of Images, Graphics, Artwork & Copy

Rebecca Jane Singh Design cannot use images, graphics, artwork or copy that violates copyright. Client supplied images, graphics artwork or copy must be sourced from reputable stock photography libraries, or the client must be the copyright holder or have written permission from the copyright holder to use the image/s, graphics, artwork or copy for commercial purposes. Rebecca Jane Singh Design can source professional stock photography, create or source artwork and graphics or write copy as required. Professional stock photography, creation or sourcing of artwork and graphics or writing of copy that is not accounted for in the initial quotation attracts an additional cost which is payable by the client.

Client Supplied Resources

Resources required for Rebecca Jane Singh Design to complete a project such as logo files, copy, graphics or other artwork must be supplied by the client before commencement of the design process, delay in providing these resources may result in a delay in commencing your project. Client must own the copyright to these resources, Rebecca Jane Singh Design will not be responsible or held accountable for any copyright or intellectual property issues arising as a result of the use of client supplied resources.

Proofs

All concepts created by Rebecca Jane Singh Design are presented in low resolution sample format for on-screen proofing. High resolution files and final works are only released once full payment is received. Rebecca Jane Singh Design exercises reasonable effort to proof and test deliverable files prior to presentation to the client. All concepts presented by Rebecca Jane Singh Design are created with the design brief provided by the client in mind. The client must confirm in writing that they approve or require revisions to supplied proofs, within 7 days of receipt of proofs.

Files & File Formats

The types of files supplied will be determined by the scope of the project and clients intended usage. For example, clients requiring their files to be suitable for print will be supplied with vector files, Rebecca Jane Singh Design ensures to provide the correct type of files for the intended applications to the client, full list of supplied file types is provided for within the quote.

Printing

Due to variations in computer settings, on-screen colour proofing may differ between monitors and devices, and can differ from the final printed result. The Client acknowledges that on-screen proofing is not an accurate representation of the final printed project, and that by Rebecca Jane Singh Design is not responsible for any colour variations that may occur between on-screen proofs and the final printed outcome.

Whilst we try our best here at Rebecca Jane Singh Design to colour match as close as possible to ensure as little variation between the colours you see on your screen and the colours you see in print, sometimes during the printing process of our Stickers, Marketing Materials, Decals, Custom Apparel, Mugs and other Accessories there will be a variation between the colours you see on your screen and the colours you receive on the physical product, this is due to a number of factors such as variation in monitor settings, print or decoration method used (digital, HTV, sublimation, DTF, screen print etc) as well as the type, colour and finish of the substrate (mugs, apparel, sticker paper, gloss or matte card stock etc) being used to create the final product.

Occasionally print colours can vary between batches, this is usually only a very slight variation and is a normal part of the printing process, however we try to minimise this where possible.

Files provided by the client to Rebecca Jane Singh Design for use in high quality printing, must be supplied as CMYK and at a minimum resolution of 300dpi at actual size and preferably in vector format. Additional charges may apply where by Rebecca Jane Singh Design is required to make changes to and or convert client supplied files, to ensure they are print ready.

Rebecca Jane Singh Design thoroughly checks all images supplied by the client and will where possible provide advice to the client regarding reproduction quality and colours. The client acknowledges and accepts that by Rebecca Jane Singh Design is not responsible for any client supplied images that do not print as expected.

Rebecca Jane Singh Design works with trade print suppliers for some jobs depending on print quantity and style required, the best print method for the job will always be recommended or selected. Files provided to these print partners must be high quality at a minimum of 300dpi at actual size, or as high-resolution PDF’s, or as per their required specifications.

Confidential Information

Rebecca Jane Singh Design and the client both acknowledge that during the course of the project they may receive certain confidential information and materials of the other party. Each party, including its agents and employees, agrees to hold and maintain in strict confidence all confidential Information, shall not disclose confidential Information to any third party, and shall not use any confidential Information except as may be necessary to perform its obligations outlined within the quote, and as may be required by law or governing authority. Confidential Information does not include any information that is in the public domain or becomes publicly known through no fault of the receiving party or is otherwise properly received from a third party without an obligation of confidentiality.

Custom Order Turnaround Times

Custom order turnaround times vary, current turn around time is communicated either within the listing or within the quote provided.

If you require your item urgently, we recommend contacting us prior to ordering to ensure that we are able to deliver within your required time frame.

In some cases, a rush fee may apply.

Returns & Exchanges

We are unable to accept refunds, returns or exchanges on custom orders and orders that have been personalised or branded, as these goods were made to order to your specifications and I would be unable to reuse or on sell them due to the personalisation or branding.

The only exception to this is where goods are faulty, the item does not match the description, is not fit for purpose or intended use, in which case the option for a repair, replacement or a refund for order will be offered.

Returns or exchanges for any other reason other than faults, the item does not match the description, is not fit for purpose or intended use will require the customer to pay return postage to get the item back to us, plus additional postage to have the exchanged item shipped to them.

Return postage of faulty items, items not matching the description or that are not fit for intended purpose or use will be covered by us.

Exchanges will not be posted until we have received the original item back to us in original unused, unwashed, unworn, unaltered condition.

Refunds

Refunds will be provided where we are required to under Australian Consumer Law, such as if the item does not match the description, is not fit for purpose or intended use or is faulty etc.

We are not obligated to refund for change of mind purchases.

Once work has commenced, the deposit paid is non-refundable. Should a refund of the deposit be required prior to commencement of work a $5 administration fee will be deducted from the deposit prior to refunding.

Refunds will be processed via the method used to make payment. If you paid via PayPal you will be refunded via PayPal, if you paid in Cash you will be refunded in Cash. Unless otherwise agreed or stated.

Refunds on returns will not be processed until we have received the item back in original unused condition.

Refunds may be offered in circumstances where we are not usually obligated to offer a refund, these will be strictly at our discretion.

Where a refund is not required under Australian Consumer Law store credit, an exchange or repair may be offered instead.

POSTAGE & HANDLING INFO

All orders to be sent with tracking, no exceptions.

business days, during busy periods or where an item is not in stock handling time may increase, we endeavour to communicate delays with our customers where possible.

Handling times vary for custom orders and are subject to stock availability, order quantity, current turnaround times and nature of the order. Custom order handling times will be communicated within the listing or direct to the customer.

Express Postage only expedites the shipping process, it does not expedite handling times, if you require your order urgently please contact us prior to ordering to arrange this, a rush fee may apply in some cases.

Postage times are just an estimate, and may vary or increase during peak periods such as Christmas, Easter, Mother’s & Father’s Day etc Make sure that when ordering you consider postage times and factor in possible delays during peak periods, we cannot control shipping delays once the goods are with our delivery partners, so will not take responsibility for items that do not arrive within your required time frame.

International Express Post: Up to 2-4 Business Days in Major Metro Areas longer outside of this.

International Standard Post: 6 Plus Business Days

International Economy Post: up to 10-30 Business Days depending on area.

LOST PARCELS

All items will be sent with tracking, should your parcel become lost during transit, you can use your tracking to lodge an investigation with Australia Post or Sendle to find out where your item is, alternatively contact us and we will lodge an investigation with Australia Post or Sendle on your behalf, we aim to get your items to you as quick as possible, but sometimes things do go wrong during the shipping process and we understand this can be frustrating for our customers, but we want to work with you, so please be patient with us while we work together to find a suitable solution.

MY ITEM ARRIVED DAMAGED OR BROKEN

Should your item arrive damaged or broken, contact us at hello@rebeccajanesinghdesign.com.au within 48 Hours of receiving your item either broken or damaged. Please provide us with photos as evidence of the damage or breakage which may have occurred during shipping.

Please help us out by also reporting via lodging a complaint with the shipping company (either AustPost or Sendle) regarding the damage or breakage that occurred during shipping please include your tracking details as well as photos when lodging the complaint. We will also lodge a complaint with them on our end to try and rectify the issue.

In the meantime, we will either replace, refund, repair where possible or provide store credit for the broken or damaged item/s.

Promotion

Rebecca Jane Singh Design retains the right to use, publish and display all clients projects within Rebecca Jane Singh Designs portfolio, website, social media advertising, printed or digital media or other exhibitions of Rebecca Jane Singh Designs portfolio of work.
